The other part of "System"

When elections are round the corner, the most uttered word and most mis-understood word by educated illiterate class is perhaps the “system”. From, former “chai wala “ to “Vice President” everyone is taking credit to show how a state is better than rest of India and how nation has glorious past. One is only busy in “talking” and other in “listening”, the atrocities on women in India have not seen any downward trend. The women in this country are raped, sexually assaulted and abused. Media highlights the issue with statistics, delay by Police to register a case, agitated crowd outside police station to get the case registered and national debates where some of the “learned” jury member blaming the current laws and delay in delivering the verdict.
In all this chaotic and somewhat true system I would like to highlight a true case happened in Chandigarh and how the same system was responsible in delivering a verdict. This is unfortunate incident happened 4 yrs back in Shelter home of Chandigarh run by govt. A 19 yr old girl was raped and was found to be pregnant. 7 men and 2 women party to crime were sent to 10 yrs imprisonment by judiciary. The reason behind highlighting the case is the “pregnancy”. Never ever in my reading I came across a girl who even dared to think of giving birth to a child out of a rape. Surprising! And surprising is, because the girl the victim in this case is intellectually disabled and her IQ was found to be of a 9 yr old. The legal stand on termination of pregnancy says that it is mandatory to obtain the prior consent of the women to abort the unborn baby. The girl, who was mentally retarded, rejected the termination of her pregnancy. She was much determined and keen in delivering her baby. We don’t know her thought process behind the decision of giving a birth to child out of rape, and her imagination how the child would grow in mean minded society? Due to this complication a formal case was registered in court of law to get a mandate from judiciary to terminate her pregnancy on various grounds. Chandigarh administration ordered for termination of pregnancy and which was seconded by divisional bench of High Court Chandigarh. The legal option, for which the victim was unaware off, was exhausting and had ruled against her wish. She was already in her 19th week of pregnancy and according to Medical Termination of Pregnancy (MTP), 1971 one can’t abort a child if lady is in 20th week of pregnancy. Considering the eagerness of a mother to bring her child to world a lawyer named Suchitra Srivastva filed a petition in Supreme Court, the last resort to seek a proper justice.
Time was critical in this case. Victim was in 19th week and had just few days in hand for SC to think all the aspects and deliver a judgment. SC thought on many issues like law, medical aspect, social aspect and international standards. The 1st and foremost question was, if at all it was decided to terminate how safe medically it would be for mentally retarded women to undergo the abortion? Court also studied the possibility of new born baby being a normal child or not? Court studied the IQ and other emotional norms related to the case. Court look into various govt system which work for such women and policies which will be helpful for the child to grow in this society. The matter was brought in urgency in front of bench of 3, headed by then Chief Justice K G Balakrishanan, Present CJI P. sathasivam and Just. B. S. Chahaun. Young lawyer Tanu bedi passionately fought for women who was not in state to understand who all and what all are the things happening for and against her single wish to deliver a baby.
This was a case where a single woman was just caring for her new un-born baby, unaware of rest things around and on other side taught Doctors, Jurist and lawyers debating on the future of single women and her child. Time was clicking, and overburdened SC took additional slot to hear the case not in hurry but with sense. Finally the judgment was out.
SC considered many point before arriving at the conclusion.
The first point was, medically the women considered was mentally retarded i.e. slow learner and not mentally ill. So according to MTP Act, consent of women is not mandatory and only in case of minor and mentally ill and where the consent of guardian should be taken into consideration. Here the mentally retarded women has given consent to give birth to her child. So her will has complete weightage.
Second point SC thought was, irrespective of sexual act, woman has freedom on her reproductive choice.
Court went to study the empirical analysis and disregarded eugenics theory which suggests that such mental diseases are carried to next generation.
SC also looked at United Nations Declaration 1971, National Trust Act 1999 and UN convention 2006, (disabled person) which keeps mentally retarded person at par with non-retarders.
Court also asked about the EQ that is required to raise a child, and also questioned about emotional imbalance if the victim would pass forceful with termination of her pregnancy.
For a single case court considered all the aspect and stayed the HC court decision of termination and respected the will and desire of women to give birth to her child. Finally the women gave birth to a healthy Baby girl.
in either case, if the child would not be a normal, Govt estb. National Trust for welfare of Persons with Cerebral palsy, mental retardation and multiple disabilities was ready to take care. Govt run National Trust have assigned a teacher to teach mother how to live and lead life, she has been taught how to make bags which she has learned and with due process and time she would be fit to take a job of an attendant. Today her daughter is 4 yrs old and both mother and daughter are happy to see each other.

This is an incident which happened in govt run shelter home, where such women were exploited but it is also the same system which punished the culprits and other part of system worked hard just because a single small woman said she want to give birth to her baby out of rape. SC studied all angles before giving a landmark judgment. We all just blame for what we see and hear, but remember we are also part of a system which we don’t know nor we take efforts to know that work for our single thought, single belief, single aspiration and make it happen for us. No matter how small we are or how smart we are.

My serious punches

1] In search of place, to place MYSELF, where...Silence is quiet and solitude is lone companion. 
                                   
2] Love is blind, but unfortunately the PAIN out of it, IS NOT..it makes you see the world in hidden dimension.

Arm Chair Revolution

Just like millions who tonight would be remembering past 365 days this moment, would be summing the whole year into simple 3 words, hilarious, average or hoping next year to be best for them. For me I am still thinking in which category I should fit myself.

 Apart from how it went for me, I would like to say how it had impact on me. Being a social animal, (please take meaning of animal in lighter way, since it has been used in very strong anti notion) things going around have impacted me in one or other way. It is usually said, our nation is divided in 2 countries itself, a country with rich having everything at their disposal and still in greed to gather more and rest who struggle to gather, just for survival. Same time, this year I found 2 types of humanities, one who criticizes every single thing in nation right from time they are out of bathroom releasing their pressure to time their conscious minds sleeps leaving to blame nation in sub conscious level; and another group who actually contributes towards nation building in one or other form, may it be like taking on street to protest, to ask, to steal the rights they feel are fundamental and denied in whatever way. My due regards to later. This started last year when Bachelor Mr Anna Hazare decided to take on corruption. Atmosphere sensed patriotism, majority joined, since many felt, corruption is not good and not accepted. Mr Anna was termed as Gandhi 2.0, in world of technology what else we can accept? But good thing was, majority of people joined for cause. government somehow managed to buy time from, and eroded the much gathering across nation. At fag end of the year, we saw same sense again, this time not for corruption, but for dignity, modesty of women in nation. Unfortunate incident on girl and nation stood unite. In this 2 agitations I found 2 class of people. 1^st who went on street, braved the climate and lathis, from “supposed law makers” and others I term as “arm chair protester . I sensed tremendous rise in such arm chair protesters,  physical contribution near to zero, but in free idle time, sitting on comfortable chair with lappy and spreading what they see, but not what they sense.

Problem gets escalated, since our much educated class is illiterate in social issues, problems, they watch, conclude with  those print and electronic media to whom Retd Justice Katju if given fair chance would punish with iron hands. Resultant “”illiterate awakened citizens” is armed with half knowledge which is dangerous and is fatal. In democratic setup these are in masses and few people who are in class are beaten by these masses dragging them to their zenith which is actual a nadir.

These people don’t have will, capacity and wisdom to do anything other than “Like”, “Share”, “Retweet”  etc etc.  even I saw the form of prayer has been changed. Now people don’t need to go and bow in front of Almighty to offer prayer, on Facebook, 1 “Like” is equivalent to 1 prayer. This is, I can say pathetic and shameful. People just read and say, “I have prayed in form of “Like” on facebook..” and they feel much privileged for contributing towards society. Now it’s only Almighty who can come on earth and can preach that He is not using Facebook, so if you really wanna pray, pray from bottom of heart and not from bottom of fingers.

But this is how society has turned up. They make hue and cry of anything supported by Media and then when it comes to 31^st December Night their well functioned brain will search for nearest DJ night and free Alcohol. Though many have showed some sense of responsibility and have denied being part of any gathering as solidarity towards victim who has slept forever with a belief that we will be awaken forever!

On edge of the New Year I would like to say, be active, rather than passively criticizing the system. We all make a system. Just now while I am writing, the news popped, that a particular media channel has declared the name, identity and picture of delhi victim and her brother respectively. What we as citizen can do actively is, denounce such paper or channel permanently. Easy thing we can do. Let the media who have no regulation at all, understand “Janata” is biggest regulator. So behave with sense.  If we do support in such a way, we can make, not this year but decades ahead happy and safe.

Wishing you a New Year with utmost sense and sensitivity, and hope we all will be active participant in shaping our future.

Protest to please - SELF

Does this has brought any change, other than your profile picture for a day???

Yesterday one of friend forwarded me a message stating that wear a black on next i.e. today in protest of Gang rape which happened in Delhi recently. Also I saw many
people turning their profile/display picture into this black dot on white background.
After looking throughout these sentiments in form of Facebook and what’s app, I feel this was the simplest form of protest. Since many of, so called proud citizen of India didn’t had time and where more concerned about their routine or perhaps they can’t do anything else they use this method to post a picture with black dot in solidarity towards victim and hate against those who did heinous crime. I always wonder how much change such things would bring except self-satisfaction that I did something towards a cause which is burning out.
I am not criticizing the thing, I favour, atleast something is better than nothing, but at same if we really want change then such “self-convenient” simple methods won’t matter other than our self. When stats says that every half hour a girl is raped, today when people changed their profile picture, some who went out discussing things for Dabhang 2 someone somewhere would be molested, teased, harassed or even raped. Even in our day to day life we see how some people in working place do such nuisance with our female colleagues, what we do at that time? Tie a black band and roam in protest or we come forward to ask the person why he did so? Moving around in public transport we find things which are obscene but we only don’t react because concerned girl is not in your relation. Are we waiting for right time to act? I feel rather than wearing blue, black or any color or choosing any simple form of protest, if we show some courage to stop, a wrong happening in front of our eyes its more than enough. Newspaper says when girl and guy where thrown out of the bus they were nude, and girl was bleeding, as many 50 people were watching the plight of this 2 citizens and strange, not a single men, women standing or peeping out of sedans took a step to cover the already destroyed modesty of women and her friend. Only when police came they took table cover from nearby hotel to cover them and took them to hospital. These 50 people who guarded the couple represent many of us. Infact might be out of those 50 few would be one who posted such picture or would have joined Jantar Mantar or India gate, or Gate way for change in nation. I am thinking with such cowards how we can bring change?
Stop showing how much you love this nation and hate such crimes on Facebook and whats app in your free time. Rather than act, because if not today, we wont get tomorrow.
